Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and XpertBiz Network ("XpertBiz", "we", "our", or "us") with respect to your access to and use of our SaaS Community & Learning Management Platform, including the website, mobile experiences, APIs and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

You must be at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872 to use the Service. By using the Service you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use.

Paid plans (Community Creator, Community + LMS Pro, etc.) are billed in advance on a recurring basis. Prices are listed on the Pricing page and may include Goods and Services Tax (GST) where applicable. All payments are processed by our payment partner Razorpay over a secure, PCI-DSS compliant channel. XpertBiz Network does not store your full card or bank details.

You agree not to: (a) post unlawful, harmful, defamatory, obscene or infringing content; (b) impersonate any person or entity; (c) attempt to interfere with the integrity or performance of the Service; (d) reverse engineer or scrape the platform; or (e) use the Service to spam, phish or harass other users.

Community owners and course creators are solely responsible for the content they publish, the legality of products and services they sell through the platform, and for honouring any promises made to their members. XpertBiz Network acts as a neutral technology provider and is not a party to transactions between creators and their members.

All software, designs, logos, marks and content created by XpertBiz Network remain our exclusive property. You retain ownership of the content you upload but grant us a non-exclusive, royalty-free, worldwide license to host, store, display and distribute it solely for the purpose of operating the Service.

We may suspend or terminate your access to the Service at any time, without prior notice, if you breach these Terms or use the Service in a way that harms us or other users. You may stop using the Service at any time by closing your account from your profile settings.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free or completely secure.

To the maximum extent permitted by applicable law, XpertBiz Network, its directors, employees and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Service. Our aggregate liability shall not exceed the amount you paid to us in the 3 months immediately preceding the event giving rise to liability.

These Terms are governed by the laws of India. The courts located in Pune, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

We may update these Terms from time to time. Material changes will be notified via email or an in-app notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
